Membership Terms & Conditions

Welcome to the People of the West Membership Area. These Terms and Conditions ("Terms") govern your access to and use of the specialized educator portal, including video streaming services, digital curriculum downloads, lesson plans, activities, and supplementary video clips (collectively, the "Materials").

By registering an account, checking the "I Agree" box, or accessing any Materials within this portal, you agree to be bound by these Terms on behalf of yourself and, if applicable, the school, school district, homeschool collective, or educational organization you represent (your "Organization"). If you do not agree to these Terms, you are not authorized to use this portal or its Materials.

1. Eligibility and Account Registration

To register for an Educator Membership, you must be a practicing educator, administrator, homeschool parent, or official representative of an educational organization. You agree to:

  1. Provide accurate, current, and complete registration data as prompted by our sign-up forms.
  2. Maintain the security of your password and identification credentials.
  3. Promptly notify People of the West if you suspect any unauthorized access to or breach of your account security.
  4. Accept sole responsibility for all activities that occur under your account username and password.

2. Intellectual Property Rights & Ownership

All content available via the Educator Membership Area—including but not limited to full-length video episodes, edited video clips, digital curriculum guides, worksheets, graphics, text, logos, and audio tracks—is the exclusive property of People of the West or its licensors. Except for the limited license explicitly granted in Section 3, all rights are expressly reserved. No title or ownership interest in the Materials is transferred to you or your Organization.

3. Limited License Grant and Permitted Uses

Subject to your compliance with these Terms, People of the West grants you a limited, non-exclusive, non-transferable, revocable, and non-sublicensable license to use the Materials solely for non-commercial, educational purposes within your specific classroom, school, or organization environment.

Permitted Actions Under This License:

  • Classroom Exhibition: You may stream or project the video episodes and clips to students within your physical or virtual classroom.
  • Curriculum Reproduction: You may download, print, and duplicate paper or digital copies of the curriculum materials, worksheets, and guides exclusively for distribution to your students.
  • Internal Organization Use: Staff members within the same physical school facility or localized non-profit staff may utilize the materials for coordinated lesson planning, provided each educator logs in via authorized organizational methods.

4. Strictly Prohibited Uses

The license granted under Section 3 is strictly conditioned upon your adherence to the following restrictions. Any unauthorized use immediately terminates your license and account access. You explicitly agree NOT to:

  1. External Distribution: Share, transfer, upload, post, or distribute downloaded curriculum files, video files, or clips to any public network, third-party platform, or shared digital repository outside your immediate classroom portal (e.g., you may not upload files to public Google Drives, YouTube, public school web pages, or social media networks).
  2. Commercial Exploitation: Use any portion of the video series, clips, or curriculum materials for commercial gain, paid tutoring programs, public screening events where admission is charged, or resale.
  3. Modification & Derivative Works: Alter, crop, edit, remix, translate, or otherwise modify the video clips or text of the curriculum materials without prior written consent from People of the West, except to adapt instructions for differentiated learning or student accommodations within your own classroom.
  4. Account Sharing: Share your personal educator login credentials with individuals outside your immediate organization, or allow non-registered third parties to bypass the sign-up gateway.

5. Data Privacy and Communication Policy

People of the West respects your privacy and is committed to protecting the personal data of educators who support our mission.

  • Non-Disclosure of Emails: We explicitly state that your email address, registration information, and organizational details will never be sold, rented, shared, or traded to third-party corporate entities or advertisers for marketing purposes.
  • Authorized Communications: By creating an account, you consent to receive periodic communications directly from People of the West. These may include platform status updates, notices regarding new episode drops, updated curriculum materials, or feedback surveys designed to improve our resources. You can opt out of educational update emails at any time via the link in the footer of the email.
  • Student Privacy Compliance: Our platform is intended for use by adult educators. People of the West does not knowingly collect, request, or store personal information from students or children through this portal, adhering strictly to relevant regional student data protection guidelines.

6. Term and Termination

These Terms remain in effect until terminated by either party. You may terminate your account at any time by contacting us and ceasing all use of the platform. People of the West reserves the right, in its sole discretion, to suspend or terminate your account, restrict access to the Materials, or cancel your membership at any time, with or without notice, if we believe you have violated these Terms or breached our intellectual property boundaries. Upon termination, you must destroy all digital and printed copies of the downloaded Materials in your possession.

7. Disclaimer of Warranties

THE EDUCATOR PORTAL AND ALL MATERIALS THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR EDUCATIONAL STANDARD, ACCURACY OF HISTORICAL ACCOUNTS, OR NON-INFRINGEMENT. PEOPLE OF THE WEST DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PEOPLE OF THE WEST, ITS DIRECTORS, CREATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE PORTAL OR MATERIALS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT, IF ANY, PAID BY YOU TO ACCESS THE PLATFORM.

9. Governing Law and Jurisdiction

These Terms shall be governed by, construed, and enforced in accordance with the laws of the jurisdiction in which People of the West is legally incorporated, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located within that jurisdiction, and you hereby consent to the personal jurisdiction and venue therein.

10. Modifications to Terms

We reserve the right to modify these Terms at any time to reflect updates to our content, changes in legal frameworks, or adjustments to our operational structure. If a material change is made, we will notify registered educators via the email address provided during registration or through a prominent notice on the website dashboard. Continued use of the portal after such modifications constitutes your acceptance of the revised Terms.
